Event & Content Guidelines
These guidelines set out what may and may not be published on UpTo. They form Annex B to the Organizer Agreement and also serve as UpTo’s content-moderation policy under the Digital Services Act (EU Regulation 2022/2065, arts. 14 and 16).
01 Prohibited events and content
You may not use UpTo for, among others:
- Illegal events or activities, or events without the required permits/licences.
- Games of chance without a Kansspelautoriteit licence.
- Events promoting hate, violence, discrimination or harassment.
- Selling alcohol / tobacco / regulated goods in breach of the law; unmarked 18+ events.
- Misleading events (fake line-ups, events you cannot deliver), ticket scalping / unauthorized resale.
- Infringing content (images/music/brands you do not have the rights to).
- Anything that breaks the App Store / Google Play policies.
Breaching these may lead to removal of the event, refunds to attendees at your cost, and termination of your account.
02 Content standards for all users
Users remain solely responsible for all content they upload, post, transmit or otherwise make available through the platform. Users may not, directly or indirectly:
- upload, post, or share content that is illegal, harmful, defamatory, obscene, discriminatory or otherwise objectionable;
- infringe or misappropriate intellectual property rights, privacy rights, or other rights of third parties;
- disrupt or interfere with the proper functioning of the platform, including by spreading malware, spam, or denial-of-service attacks;
- extract, scrape, harvest, or otherwise collect data from the platform for unauthorized or commercial purposes, whether manually or by automated means;
- misrepresent identity, age or affiliation, or engage in fraudulent or deceptive practices;
- use the platform to solicit or collect sensitive personal data (such as health data or government IDs) beyond what is strictly necessary for participation in an event;
- use the platform for any unlawful purpose.
You must hold all rights necessary to the content you upload, and it must not infringe third-party rights or violate applicable law.
03 Organizer responsibilities
You are responsible for your event: its legality, safety, permits, and delivering it as advertised. Events may require UpTo approval before publication; approval is not an endorsement and does not transfer any responsibility to UpTo.
You must mark events that are 18+ (e.g. involving alcohol) and comply with age-verification duties at the door (in the Netherlands, NIX18 under the Alcoholwet). This duty is yours, not UpTo’s.
You are responsible for any licence your event needs: music rights (Buma/Stemra), alcohol (Alcoholwet), games of chance (only with a Kansspelautoriteit licence), public-event permits, and similar.
Each event includes an in-app chat environment for registered attendees. Organizers are responsible for moderating that chat, while UpTo may also monitor or intervene.
04 How we moderate
UpTo may use automated tools, including artificial intelligence systems, to monitor, filter and moderate content on the platform, for example in group chats and event pages, to detect and limit illegal content or content incompatible with our Terms.
Moderation measures are applied consistently with the Digital Services Act, including the principles of proportionality, transparency and respect for fundamental rights. UpTo has no general obligation to monitor content, and moderation is limited to targeted measures.
Where content is restricted, modified or removed, or access to it is disabled, the affected user will be informed of the decision and the main reasons for it, unless notification is not required under applicable law.
UpTo publishes, at least once per year, a clear and accessible report on its content-moderation activities, including the number and type of notices received, average processing time, measures taken, and the use of automated tools.
Where UpTo becomes aware of content giving rise to serious criminal offences, including terrorism-related content, child sexual abuse material, or other offences creating an imminent threat to life or safety, UpTo may notify the competent law-enforcement or regulatory authorities.
05 Reporting and appeals
Users and third parties may notify UpTo of allegedly illegal content or violations of these guidelines through the in-app reporting functionality. Notices must contain sufficient information to enable UpTo to identify the content in question and assess its lawfulness.
Upon receiving a notice, UpTo reviews the report in a timely, diligent and proportionate manner. We make reasonable efforts to process and decide on notices within forty-eight (48) hours of receipt.
Users have access to an internal complaint-handling system to challenge moderation decisions. Complaints must be submitted through the in-app functionality or by email within fourteen (14) days after receipt of the notification, and will be reviewed within fourteen (14) days of receipt.
